INSTRUCTION TO TENDERERS

1. Tenderers will be provided with:
(a) a copy of the Tender Document
  Tender document and other information can be obtained from :-

Fisheries Department,
3rd Floor, Ministry of Industry and Primary Resources,
Jalan Menteri Besar, Bandar Seri Begawan BB3910,
Brunei Darussalam.

Tenderers are to submit Tender Document duly completed, including specifications, appendix and any other information requested, in plain sealed envelope marked :-

and placed in the Mini Tender Board Box at the said address not later than Tuesday, 24 June 2008 at 2.00 p.m.
3. (a) In the case of any Tender not being delivered by hand, the Tenderer must arrange for his Tender and other documents to be posted in time to reach the above stipulated place, not later than the stated date and time.
(b) Any Tender delivered after the stipulated time, from whatever cause arising, will not be considered.
(c) In no case will the Government be responsible for any expenses or loses incurred by a Tenderer in preparation of this tender.
4. The tender fee is B$50.00, which will NOT be refunded.
5. Before tendering, the Tenderer shall carefully examine the relevant conditions of Contract, Specifications, Schedules, Bills, Appendices and other accompanying documents, which shall form part of the contract. If there should be or appear to be any discrepancy between any of those documents, the Tenderer should immediately refer the matter to the Fisheries Department.
6. (a) Each Tenderer must submit in closed and sealed plain enveloped addressed as stipulated in the Tender Notice, a genuine tender on the Form of Tender provided, together with the copy of the Schedule of Tender in which is duly filled and signed AND a valid business registration certificate. Any form of Tender, which is incomplete and unsigned shall be disqualified.
(b) The Tenderer shall price the Schedule of Tender which shall be filled in ink and signed. The rate shall be scrutinized and adjusted (if necessary) by the tenderer but the total Tender Sum shall remained unchanged.
7. The Tenderer shall attach a copy of company's registration which include name, registration number and owner's identity card or passport.
8. The Tenderer is required to fill up the declaration form, as attached complete with signature and company's stamp.
9. Where applicable, the tender price shall be CIF price Brunei Darussalam.
10. No unauthorized alteration or addition shall be made to the Form of Tender or any Tender Documents.
11. The Tender shall be made on the basis of the rates and prices in the Tender Documents being firm and not subject to unauthorized adjustment with variations in wage rates, price of materials or any other costs.
12. The Tenderer shall be deemed to have satisfied himself before submitting his tender, the extent of work required, and in general, to have obtained for himself all necessary information as to risks, contingencies and all circumstances influencing and affecting his tender.
13. The Government shall not be bound to accept the lowest of any Tender, nor assign any reason for the rejection of any Tender.
14. All Schedules of Particulars attached to the Tender Document shall be completed and submitted by the Tenderer together with his tender.
15. Any notice to be given to the Tenderer may be posted to the Tenderer's address given the Tender Document and such posting shall be deemed good service of such notice.
16. The word "Successful Tenderer" shall mean that the Tenderer whose tender have been approved and accepted by the Government.
17. The word "Tenderer" in this condition shall deemed to include two or more persons.
18. Non-compliance with the above conditions in any respect shall render the tender liable for rejection.
19. These conditions of tendering, in so far as they may affect the execution of the contract, shall deem to form part of the contract.
20. A Tenderer, whether or not he submits a tender, shall treat the details of the Tender Documents as private and confidential.
